Paper 1: “The Strata Titles Act 1985, The Strata Titles (Amendment) Act 2013 & The Strata Management Act 2013”

The Strata Titles Act 1985 was amended in early 2007 to cater to landed strata parcels amongst other things.

Early this year, Parliament passed the Strata Titles (Amendment) Act 2013 [Act A1450] and repealed the Building and Common Property ( Maintenance and Management) Act 2007 and replaced it with the Strata management Act 2013 [Act 757].

This seminar is a refresher session for those unfamiliar with the Strata Titles Act 1985 especially with respect to Landed Strata Title developments and an update and informing session to practitioners and those interested in Strata Titled Developments on the implications and impact of the latest amendments to the Strata Titles Act 1985.

Paper 1: “The Limitation Act and The Architect”

To sue or not to sue…. If one dwells on the question for too long, one might find that it could be too late to sue.

A common concern of practising Architects is the prospect of being sued or being included in a legal suit for damages arising from some past action carried out in the course of their job or provision of service as an Architect.

Legally, all actions arising from tort and contract have limitation periods as provided for in the Limitation Act 1953 (Act 254). The Act imposes a limitation period or a time frame within which a party must bring a claim or commence legal action.

When the Limitation Period has expired, it is perfectly proper for the party being sued to use the expiry of the relevant period as a complete defense in a court of law.

Understanding the gist of the Limitation Act 1953 and its relevance to Architects in practice may ease unnecessary stress as well as aid in better management of risks as well as preservation of rights (such as collection of outstanding fees) which may otherwise become void if action is not taken in a timely manner.
